The majority of Janet’s mediation training was at Brigham Young University and Innovative Training Solutions (by Master Mediator & Attorney Tamara Fackrell, PhD).
Janet graduated Summa Cum Laude from Snow College (Major: Psychology) and Cum Laude from Brigham Young University with double bachelor degrees in Communication Disorders and Home & Family Studies. Janet also has extensive experience working in the education field (public/private schools), in the medical/dental industries, and working with families of diverse backgrounds. Having her own blended family has given Janet many years of experience helping people resolve differences and find workable solutions.
Janet has a lot of experience working with individuals and families in crisis. She is a member of the Utah Council on Conflict Resolution and is the President of the Board of Trustees of the Friends of Sanpete County Children’s Justice Center. She is also a professional educator (Utah educators license) and a former Advanced Emergency Medical Technician (AEMT). She enjoys writing children’s books and parables, has been published in several periodicals, and is the recipient of the US President’s Silver Volunteer Service Award and other local recognition. She is a member of the Phi Theta Phi and Phi Theta Kappa International Honors Societies.
What to Expect
Individuals or attorney’s call Janet when they need a neutral facilitator to help resolve a conflict. She gathers the basic information including: type of dispute, their contact information and availability, and the contact information for the other parties involved. Janet contacts the other party(ies) and/or their attorney(s) to schedule the mediation. Janet confirms the agreed upon date/time/place of the appointment via e-mail and sends each party an Agreement to Mediate (so they know what to bring and expect from the mediation process). Parties review, sign, and return this form prior to convening mediation. If doing the mediation on-line, Janet also sends parties their own Google Calendar appointment, with a link to their private teleconference caucus/meeting (each party has their own private caucus with her and/or their attorney) and/or a group caucus for when parties want to speak face to face.
During the mediation, Janet listens to the issues from all parties involved and their proposed solutions. Negotiations proceed from there. If meeting in private caucuses, she goes back and forth between the parties exploring the issues and ideas until a resolution is reached. Janet seeks for win-win solutions where the basic needs of the clients and all parties involved (including the children, if applicable) are considered.
If parties are not represented by attorneys, Janet types up the Mediated Agreement or Memorandum of Understanding. She shares the viewable Google document with all parties, so they can review it and ensure accuracy. Parties may sign and have it notarized by Janet (if in person) or may wish to consult with their attorney and/or an accountant prior to signing. If on-line, the parties can take the final agreement and get it notarized before filing it with the court. Janet also provides the Alternative Dispute Resolution (ADR) notice to clients (and attorneys) to file with the court, showing the results of the mediation.
